As I was investigating into the backgrounds of Oakville elected officials for any possible breaches in the Oakville Council Code of Conduct as part of investigating for the proposed Class Action which has been filed against the Town of Oakville and the Province of Ontario et al. I discovered a situation of great concern to me as an Oakville resident and taxpayer.
To clarify, the proposed Class Action alleges that due to decades of over development upstream, and the alleged failures to follow Provincial flooding hazard guidelines combined with the alleged failures to map the expanding floodplains downstream residents have suffered or are at risk of suffering property damage or loss of life. The Defendants’ ongoing conduct allegedly contributed to increased flooding risks in major storms and led to regulatory restrictions on the use, development, or enjoyment of their property.
The Town of Oakville website confirms that it has the authority to sell property when taxes on property are outstanding for a period of two years or more by issuing a public tender. The sale would be governed by the Municipal Act, 2001 and the Municipal tax Rules made under the Act.
During my research, I discovered that the Town of Oakville had placed a lien for tax arrears in the amount of $20,367.00 on the personal property of an elected official (Regional Councillor). This would constitute approximately 4 years minimum of tax arrears so why does it appear that no action was taken by The Town of Oakville to issue a tender to sell the property? It does appear like the Regional Councillor received preferable treatment. How is this fair to the other homeowners that had their properties sold for the payment of tax arrears?
In addition, The Town of Oakville could have registered a lien or Tax Arrears Certificate on title as per the Ontario Municipal Act, 2001 if property taxes are two calendar years in arrears, which was not done. The Tax Arrears Certificate was registered at approximately 4 years based on the arrears amount.
As a Candidate for Ward 5 Town Councillor, I am disgusted and infuriated that this elected official would receive preferable treatment.
